This International Trade Compliance Policy applies to www.gotorex.com, a multi-seller e-commerce marketplace operated from South Africa and serving customers internationally.

Gotorex is committed to conducting international marketplace activities in accordance with applicable trade, customs, sanctions, export-control and import laws. Because requirements differ between countries, products and transactions, additional restrictions may apply.

1. Compliance With Trade Laws

Sellers and other marketplace users must comply with applicable laws concerning:

  • Import and export;
  • Customs;
  • Sanctions;
  • Export controls;
  • Restricted parties;
  • Product restrictions;
  • Country restrictions;
  • Customs declarations;
  • Trade documentation; and
  • Other applicable international-trade requirements.

2. Seller Responsibility

Sellers are responsible for ensuring that products they offer through Gotorex can legally be sold, exported and imported into the intended destination.

Sellers must provide accurate information where required, including:

  • Product description;
  • Product value;
  • Quantity;
  • Country of origin;
  • Product classification;
  • Shipping information;
  • Required licences or permits; and
  • Other customs or regulatory information.

Sellers must not knowingly provide false or misleading information.

3. Prohibited & Restricted Transactions

Gotorex may prohibit or restrict transactions involving:

  • Sanctioned countries or territories;
  • Sanctioned individuals or organisations;
  • Restricted parties;
  • Controlled goods;
  • Products requiring licences that have not been obtained;
  • Products prohibited by the destination country;
  • Goods subject to export restrictions;
  • Counterfeit goods;
  • Unsafe products; or
  • Other transactions prohibited by applicable law.

The list of restricted products and destinations may change as laws and regulations change.

4. Sanctions Screening

Gotorex may use reasonable measures to identify and restrict transactions involving sanctioned or restricted persons, entities, countries or territories.

Where legally required or appropriate, Gotorex may:

  • Decline a transaction;
  • Cancel an order;
  • Restrict an account;
  • Delay processing;
  • Request additional information; or
  • Report or cooperate with competent authorities.

5. Export Controls

Certain products, technologies, software, equipment or information may be subject to export-control laws.

Sellers are responsible for obtaining applicable export licences, permits or approvals before shipping controlled products.

Gotorex may restrict or prevent transactions where the required authorisation cannot be established.

6. Import Requirements

Customers and sellers must comply with applicable destination-country import requirements.

Depending on the product and destination, requirements may include:

  • Import permits;
  • Product certifications;
  • Customs declarations;
  • Labelling requirements;
  • Safety requirements;
  • Registration requirements;
  • Duties and taxes; or
  • Other government approvals.

A product being available on Gotorex does not guarantee that it can legally be imported into every country.

7. Customs Documentation

Where required, accurate customs information must accompany international shipments.

This may include:

  • Product description;
  • Value;
  • Quantity;
  • Country of origin;
  • HS or tariff classification;
  • Sender and recipient information; and
  • Other information required by customs authorities.

False declarations, undervaluation or misclassification intended to avoid customs requirements are prohibited.

8. Country & Destination Restrictions

Gotorex or individual sellers may restrict delivery to particular countries or territories.

Restrictions may be applied because of:

  • Sanctions;
  • Export controls;
  • Import restrictions;
  • Product regulations;
  • Customs requirements;
  • Payment restrictions;
  • Shipping limitations;
  • Legal uncertainty; or
  • Other compliance considerations.

Gotorex may change destination availability without notice where reasonably necessary to comply with law.

9. Product-Specific Controls

Additional rules may apply to products such as:

  • Medicines and medical products;
  • Food and beverages;
  • Cosmetics;
  • Chemicals;
  • Batteries;
  • Electronics;
  • Children's products;
  • Weapons and weapon-related products;
  • Wildlife or protected materials;
  • Plants and animal products;
  • Dual-use goods;
  • Radio or telecommunications equipment; and
  • Other regulated products.

Such products may require additional documentation, licences or destination-specific restrictions.

10. Customs Duties, VAT & Import Taxes

International shipments may be subject to customs duties, VAT, GST, sales tax, import taxes or other government charges.

Responsibility for these charges depends on the transaction, shipping arrangement and applicable law.

11. Shipping & Delivery

International shipping times vary according to the seller, supplier, warehouse, carrier, destination, customs and shipping method.

Some products may be delivered as quickly as 1–3 business days in countries such as the United States, while other products may take substantially longer.

Customs inspections and government processing may cause delays beyond the estimated delivery period.

12. Trade Compliance Records

Gotorex and/or sellers may retain transaction and trade-related information where required or permitted by law, including:

  • Seller information;
  • Order information;
  • Product information;
  • Shipping records;
  • Customs documentation;
  • Payment records; and
  • Compliance-related communications.

Information will be handled in accordance with the Gotorex Privacy Policy and applicable data-protection laws.

13. Compliance Checks

Gotorex may conduct reasonable compliance checks before or after an order.

This may include reviewing:

  • Seller information;
  • Product information;
  • Destination;
  • Transaction details;
  • Customs information;
  • Sanctions information; and
  • Other relevant compliance information.

Gotorex may request additional documentation where reasonably necessary.

14. Suspicious Transactions

Gotorex may restrict, delay or cancel a transaction where there are reasonable concerns regarding:

  • Sanctions;
  • Export controls;
  • Customs fraud;
  • False documentation;
  • Product restrictions;
  • Money laundering;
  • Unlawful imports or exports; or
  • Other trade-compliance risks.

Where legally required or permitted, Gotorex may cooperate with regulators, customs authorities, law-enforcement agencies and other competent authorities.

15. Returns, Refunds & Cancellations

Returns, refunds and cancellations are governed by the Gotorex Refund, Return & Cancellation Policy and mandatory consumer laws applicable to the transaction.

Customers should contact:

for eligible:

  • Refund requests;
  • Return requests;
  • Cancellation requests;
  • Damaged-product reports; or
  • Incorrect-product reports.

Customers may be required to provide reasonable evidence.

Gotorex may inspect the product and investigate with the seller, supplier or carrier before determining eligibility where permitted by law.

The time required for inspection and resolution depends on the circumstances and complexity of the matter.

Mandatory consumer rights remain unaffected.

16. Trade Compliance Violations

Violations of this Policy may result in measures including, where legally permitted:

  • Listing removal;
  • Transaction cancellation;
  • Shipping restrictions;
  • Account restrictions;
  • Seller suspension;
  • Seller termination;
  • Withholding or delaying seller payouts where legally permitted; or
  • Reporting to appropriate authorities.

17. No Circumvention

Users must not attempt to circumvent:

  • Sanctions;
  • Export controls;
  • Import restrictions;
  • Customs requirements;
  • Product restrictions;
  • Destination restrictions; or
  • Gotorex compliance controls.

This includes using false information, intermediaries or alternative shipping arrangements for the purpose of avoiding legal restrictions.

18. International Legal Requirements

Trade laws vary between jurisdictions.

Gotorex does not represent that a product permitted for sale in one country is automatically lawful to sell, export or import into another country.

Sellers and customers are responsible for complying with mandatory requirements applicable to their respective activities.

Where Gotorex has legal obligations in a particular jurisdiction, it will comply with those obligations.

19. Policy Changes

Gotorex may update this Policy when international trade laws, sanctions, customs requirements, marketplace operations or compliance procedures change.

The latest version will be published on www.gotorex.com.
