Gotorex Intellectual Property Policy

This Intellectual Property Policy applies to www.gotorex.com, an international multi-seller marketplace operated from South Africa.

Gotorex respects copyrights, trademarks, patents, designs and other intellectual-property rights. Sellers and users are responsible for ensuring that their activities and content on Gotorex do not infringe the rights of others.
1. Prohibited Intellectual-Property Infringement
Users and sellers may not upload, list, sell, advertise, distribute or promote content or products that infringe another person's or company's intellectual-property rights.
This includes, where applicable:
- Counterfeit or fake branded products;
- Unauthorised use of trademarks;
- Copyright-infringing products or content;
- Pirated software, films, music or other protected works;
- Unauthorised reproductions or copies;
- Products using stolen designs;
- Unauthorised use of photographs or videos;
- Patent-infringing products;
- Unauthorised replicas or designs; and
- Content falsely claiming affiliation with a rights holder.
2. Seller Responsibility
Sellers are responsible for ensuring that they have the legal rights, licences or permissions necessary to:
- Sell their products;
- Use trademarks;
- Use product photographs;
- Use product descriptions;
- Use videos;
- Use logos;
- Use designs; and
- Upload other intellectual-property-protected material.
A seller must not assume that content found on the internet is free to use.
Sellers may be required to provide proof of ownership, licensing, authorisation or authenticity.
3. Copyright
Copyright may protect photographs, artwork, videos, written descriptions, software, graphics, music and other original works.
Users must not copy or upload copyrighted material without permission or another valid legal basis.
Gotorex may remove content where it receives a credible copyright complaint or otherwise becomes aware of potentially infringing material, subject to applicable law.
4. Trademarks
Sellers must not use another party's trademark in a misleading manner or falsely imply that a product is:
- Manufactured by;
- Approved by;
- Sponsored by;
- Endorsed by; or
- Officially associated with
a trademark owner when no such relationship exists.
Legitimate sellers may use trademarks where legally permitted, including where necessary to accurately identify genuine products, subject to applicable law.
5. Counterfeit Products
Counterfeit products are prohibited.
Gotorex may remove listings and take action against sellers where it reasonably believes products are counterfeit or unauthorised.
Where appropriate, Gotorex may request evidence such as:
- Purchase invoices;
- Supplier information;
- Distribution authorisation;
- Certificates of authenticity;
- Manufacturer documentation; or
- Other reasonable evidence.
6. Reporting Intellectual-Property Infringement
Rights holders or authorised representatives may report suspected infringement to:
A report should contain sufficient information for Gotorex to identify and investigate the alleged infringement, including where applicable:
- Name and contact details of the rights holder or authorised representative;
- Identification of the intellectual property concerned;
- Evidence of ownership or authority to act;
- Identification of the allegedly infringing listing, content or product;
- Explanation of the alleged infringement;
- Supporting evidence; and
- A statement confirming that the information provided is accurate to the best of the reporter's knowledge.
Additional information may be requested where reasonably necessary.
7. Investigation & Removal
After receiving a credible report, Gotorex may investigate the listing or content.
Where appropriate and permitted by law, Gotorex may:
- Temporarily restrict a listing;
- Remove allegedly infringing content;
- Request information from the seller;
- Request proof of ownership or authorisation;
- Notify the affected seller;
- Restrict transactions;
- Suspend a seller; or
- Take other appropriate action.
Gotorex does not make a final legal determination in every dispute and may require the parties to provide supporting evidence or pursue the appropriate legal process.
8. Seller Response & Counter-Notice
Where appropriate, Gotorex may give the affected seller an opportunity to respond to a complaint.
A seller may provide evidence showing that:
- It owns the relevant rights;
- It has permission or a licence;
- The product is genuine;
- The content is lawfully used; or
- The complaint is otherwise unfounded.
Where applicable law provides specific notice-and-counter-notice procedures, Gotorex will follow the legally applicable procedure.
9. Repeat Infringement
Gotorex may restrict, suspend or terminate sellers or users who repeatedly infringe intellectual-property rights.
Serious infringement, counterfeit activity or deliberate attempts to circumvent enforcement may result in immediate action where permitted by law.
10. Gotorex Intellectual Property
The Gotorex name, logo, website design, platform software, graphics, text, trademarks and other original Gotorex materials may be protected by intellectual-property laws.
Except where permitted by law or expressly authorised by Gotorex, users may not copy, reproduce, modify, distribute, sell or commercially exploit Gotorex intellectual property.
11. Seller Content Licence
Sellers retain ownership of intellectual property they legally own.
By uploading product photographs, descriptions, videos, trademarks and other content to Gotorex, sellers grant Gotorex a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, adapt and use that content as reasonably necessary to operate, advertise and promote the marketplace and the seller's listings.
The seller confirms that it has the rights necessary to grant this licence.
This licence does not transfer ownership of the seller's intellectual property to Gotorex.
12. Customer Content
Where customers submit reviews, photographs, videos or other content, they remain responsible for ensuring that their submissions do not infringe another person's rights.
Gotorex may moderate, remove or restrict content that violates applicable law or Gotorex policies.
13. False or Abusive Reports
Reports must be made in good faith.
Knowingly submitting false, misleading or fraudulent intellectual-property complaints may result in account restrictions or other action where permitted by law.
14. International Intellectual-Property Rights
Intellectual-property rights differ between countries.
A product, design, trademark or other material may be lawful in one jurisdiction but protected or restricted in another.
Sellers are responsible for determining whether their products and content may lawfully be sold, advertised and delivered in the relevant destination.
Gotorex may restrict listings by country where necessary to comply with applicable law or rights-holder requirements.
15. Returns, Refunds & Damaged Products
Intellectual-property complaints are separate from ordinary customer return and refund requests.
Customers requesting a refund or return for a damaged, defective or incorrect product should contact:
Customers may be required to provide reasonable proof, including photographs, videos, order information or other evidence.
Gotorex may inspect the product and investigate with the applicable seller, supplier or carrier before determining eligibility.
The time required for inspection and resolution may vary according to the product and circumstances.
Any mandatory consumer refund, return, cancellation or other legal remedy remains unaffected.
16. Enforcement & Legal Cooperation
Where permitted or required by law, Gotorex may cooperate with:
- Rights holders;
- Courts;
- Regulators;
- Customs authorities;
- Law-enforcement agencies; and
- Other competent authorities.
Gotorex may provide information or take action where legally required.
17. Changes to This Policy
Gotorex may update this Policy as intellectual-property laws, marketplace requirements or its services change.
