Gotorex is committed to maintaining a marketplace where products offered to customers are lawful, properly described and compliant with applicable safety and product requirements.
1. General Product Safety Requirement
Sellers may only offer products that are:
- Safe for their intended and reasonably foreseeable use;
- Genuine and legally sourced;
- Compliant with applicable laws and regulations;
- Properly labelled and packaged where required;
- Accompanied by required instructions and safety information; and
- Permitted to be sold and shipped to the relevant destination.
A product that is lawful in one country may still be restricted or prohibited in another.
2. Seller Responsibility
Sellers remain primarily responsible for ensuring that their products comply with the laws applicable to the products and markets in which they are offered.
Depending on the product and destination, sellers may be required to provide:
- Manufacturer information;
- Importer or responsible-person information;
- Product identification;
- Batch, serial or model information;
- Safety warnings;
- Instructions;
- Required certifications or conformity information;
- Test reports or technical documentation; and
- Other legally required information.
For EU sales, product offers can be subject to specific manufacturer, responsible-person, product-identification and safety-information requirements.
3. Product Listing Requirements
Where applicable, Gotorex may require safety and compliance information to appear directly on the product listing.
Listings must accurately describe the product and must not contain misleading safety, certification, performance or regulatory claims.
Gotorex may prevent a listing from being published where required compliance information has not been provided.
For marketplaces covered by the EU General Product Safety Regulation, marketplace interfaces must support the provision and display of required product safety and traceability information.
4. Compliance Documents
Gotorex may request documentation before or after a product is listed, including:
- Proof of authenticity;
- Manufacturer information;
- Safety certificates;
- Conformity documentation;
- Test reports;
- Product photographs;
- Labelling information;
- Country-of-origin information;
- Import or export documentation; and
- Other information reasonably necessary to assess compliance.
Providing documentation does not necessarily mean that Gotorex has certified or guaranteed the product's compliance.
5. High-Risk & Regulated Products
Certain products may require additional review, documentation, approvals, age restrictions, licences or destination-specific compliance.
Gotorex may impose additional requirements or prohibit categories of products where necessary to protect customers or comply with applicable law.
Sellers must not list products that are prohibited under the Gotorex Prohibited & Restricted Products Policy.
6. Recalls & Safety Problems
Sellers must promptly notify Gotorex if they become aware that a product:
- Has been recalled;
- May present a serious safety risk;
- Has caused or may have caused an accident;
- Is subject to regulatory action;
- Is prohibited or restricted in a relevant market; or
- Requires corrective action.
Gotorex may suspend sales, remove listings, notify affected customers, coordinate corrective action and cooperate with authorities where required.
EU product-safety rules require relevant businesses to act on dangerous products and provide affected consumers with appropriate recall information and remedies.
7. Customer Safety Reports
Customers should report potentially dangerous, defective or non-compliant products to:
Reports should include, where available:
- Order number;
- Product name;
- Seller name;
- Description of the safety concern;
- Photographs or video;
- Product or model number; and
- Other relevant evidence.
Gotorex may investigate the report and take appropriate action.
8. Damaged or Defective Products
Customers who receive a damaged, defective or potentially unsafe product should email:
Customers may be asked to provide photographs, video, packaging information, order information or other reasonable evidence.
Gotorex may inspect the product and investigate with the seller, supplier, manufacturer or carrier before determining the appropriate resolution.
The inspection and resolution period may vary depending on the product, seller, evidence and circumstances.
Any applicable refund, replacement, repair, return or other remedy will be handled under the Gotorex Refund, Return & Cancellation Policy and applicable mandatory law.
Nothing in this Policy removes a consumer right that cannot legally be excluded.
9. International Compliance
Because Gotorex serves customers internationally, compliance may depend on both the product and destination.
Sellers are responsible for considering applicable:
- Product-safety laws;
- Consumer-protection laws;
- Labelling requirements;
- Certification requirements;
- Import and export rules;
- Customs requirements;
- Environmental requirements;
- Age restrictions; and
- Other destination-specific regulations.
EU rules, for example, require consumer products sold in the EU to be safe regardless of where they were manufactured.
10. Marketplace Monitoring
Gotorex may use reasonable measures to identify potentially unsafe or non-compliant products, including:
- Seller verification;
- Documentation requests;
- Product reports;
- Listing reviews;
- Safety databases and regulatory information;
- Random or risk-based checks; and
- Information received from customers, sellers, authorities or other parties.
For marketplaces subject to the EU GPSR, specific obligations include internal product-safety processes, Safety Gate registration, handling safety notices and certain random checks of products offered through the marketplace.
11. Removal & Enforcement
Where permitted by law, Gotorex may:
- Reject a product listing;
- Remove a product;
- Restrict a product by country;
- Request additional documentation;
- Suspend sales;
- Notify customers;
- Require corrective action;
- Suspend a seller; or
- Terminate a seller's marketplace access.
Where applicable law requires notice, reasons or an appeal mechanism, Gotorex will provide the applicable process.
12. Government & Regulatory Requests
Gotorex will cooperate with competent authorities and regulators as required by applicable law.
Where legally required, Gotorex may provide information concerning products, sellers, transactions, complaints, recalls or corrective actions.
13. Shipping & Delivery
Product safety requirements can affect whether a product may be shipped to a particular destination.
Shipping times vary between sellers, products, warehouses and carriers. Certain products may be delivered as quickly as 1–3 business days in certain countries, including the United States, while other products may take substantially longer.
Delivery estimates do not override product-safety, customs, import, export or regulatory requirements.
14. Changes to This Policy
Gotorex may update this Policy when product-safety laws, regulations, marketplace requirements or operational practices change.
The latest version will be published on www.gotorex.com.
